Policy Statement
This Policy and Guidance explains what steps need to be taken when Bubble and Bounce Swim Ltd. obtains images for its own use and when films or photographs are taken by others during Bubble and Bounce Swim classes. For the avoidance of doubt, this Policy and Guidance applies to cameras, mobile phones, videos and any other equipment capable of recording images. Any reference to photographs and photography should be interpreted as including filming.
In accordance with our Child Protection Policy, we will not permit photographs, video, or other images of young people to be taken without consent. If a child is under 18 years of age, consent must be obtained from a parent or carer. Such consent must be obtained from the child’s parent or guardian on the official consent form during the registration process. Bubble and Bounce Swim Ltd. will take all steps to ensure written consent has been given by all participants prior to practical sessions. We will ensure any images are used solely for the purposes for which they are intended. If you become aware that images are being used inappropriately, please inform us immediately.
Section 1: Consent
Photo consent forms must be completed by all individuals prior to participation in Bubble and Bounce Swim Ltd. sessions. Consent forms must be on site for any sessions run by the Bubble and Bounce Swim Ltd. team. Once a form has been signed the specified conditions must be adhered to. The forms will be stored alongside any photos to which they apply.
Withdrawal of consent. An individual who has given consent may wish to withdraw that consent at a later date. If consent is withdrawn the individual must be advised that Bubble and Bounce Swim Ltd. cannot recall any publications or films in which their image appears. However once consent is withdrawn, no further use can be made of that individual’s image and it should be deleted.
The Data Protection Act will apply where the photographs are taken for company use and stored with personal details such as names or email addresses.
Section 2: Publicity
Bubble and Bounce Swim Ltd. uses photography and filming for publicity, marketing and company training purposes. Images are either electronic or in the form of photographic prints, typically coming from these sources:
1. Taken by a member of staff with a company camera
2. Taken by a commissioned professional photographer with valid ID and DBS checks
Bubble and Bounce Swim Ltd. will commission images or filming for a number of reasons and uses. They include:

Printed materials such as newsletters or brochures

Display materials, such as banners, posters or flyers

To use on the internet and/or its own website(s)

To use on social media networks such as Facebook/Instagram, which includes sharing/’tags’

For company staff training purposes and CPD studies
Section 3: Social Media
Use of images on social media sites. Photos may be included on Bubble and Bounce Swim Ltd.’s social media pages or website. These images can be seen across the world wide web, and anyone choosing to access the company’s social media sites – which means that permission has been sought for this purpose. No personal information will be used with these images, to ensure participants are protected. They will only be used for the company's promotional purposes. From it’s social media pages, Bubble and Bounce may ‘tag’ promotional pages, such as Be Social, Swim England, Birthlight or other relevant pages. This has been highlighted in our photo consent form. If a member of the public adds/tags any images to Bubble and Bounce Swim Ltd.’s Facebook page, Bubble and Bounce Swim Ltd. is not able to take any responsibility for this, but if there are any inappropriate images then Bubble and Bounce Swim Ltd. will remove them from the page.
Section 4: Participant / Spectator Photography and Filming
The Data Protection Act does not prevent individuals from taking photographs for their families, friends and colleagues. Bubble and Bounce Swim Ltd. does not wish to prevent individuals from taking photographs of their children or family for personal use. However, we also appreciate that individuals using public facilities or partaking in group sessions do not expect to be photographed or filmed by others, particularly when their image could be published on the internet without their knowledge. Bubble and Bounce Swim Ltd. is particularly mindful of its child protection obligations and seeks to protect everyone and in particular children and vulnerable adults from unwanted photography or filming during its sessions.
It is against company policy to take any photos or film footage of other people’s children or family during a session. Should spectators wish to take photos of their children / family during Bubble and Bounce Swim Ltd. classes, this can be arranged with approval of the Teacher or relevant member of staff who is on site. I.e. photos can be taken at the end of the session, when the pool is clear of other individuals or staff members. Please ensure any individual who is not associated with your immediate family or personal circles is not captured in the background of any photo or film footage.
Photography is not permitted in changing rooms, showers, locker areas or toilets or any other area that the Duty Manager may decide upon at their discretion. Anyone found to be taking photographs without permission which are intrusive or inappropriate will be reported to the Police and Leisure Centre Manager by way of a report of concern (regarding child protection issues).
Section 5: Storing Images
Images containing individuals must be stored in a restricted file with a copy of the relevant completed consent form, which only the Communications Team has access to. Images will be filed by date and year, and will be reviewed every three years by the Communications Team. Disposal of images – photographs that are out of date or no longer usable will be destroyed appropriately by shredding and deletion of the electronic version.
